About the Position: NOTICE OF VETERANS' PREFERENCE: There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of the Army considers veterans' preference eligibility a positive factor for attorney hiring.     Incumbent serves as a Labor Counselor/ Employment Law Trial Attorney/advisor and consultant. Will represent the command in third-party administrative, quasi-judicial, and judicial proceedings on civilian personnel, labor relations and equal employment opportunity matters. Trial attorney duties includes establishing case strategy/tactics; prepares pre-hearing motions and petitions; identifies relevant witnesses and documents and represents the government at the hearing. Prepares post-hearing briefs/appeals or responses. Performs Attorney-Advisor duties by providing oral and written advice/technical legal guidance to key officials and subordinate installations concerning law of federal employment/federal labor-management relations, including adverse actions, performance management, and equal employment opportunity issues. Provides advice and prepares opinions on legal issues or factual questions, some of which lack clearly applicable precedents or contain complex factual scenarios.

Knowledge of laws, regulation, policies, procedures, and court rules affecting practice in the areas of and before the Merit Systems Protection Board, the Federal Labor Relations Authority, The Equal Employment Opportunity Commission, federal arbitrators and the Department of Defense Office of Complaints Investigations. (2). Ability to provide accurate and timely legal advice on complex questions of Federal Laws, Regulations (Including Army and/or Department of Defense specific regulations), Policies and Procedures. (3). Ability to research legal issues, analyze and interpret Statues, Regulations, Precedents, Policies, and Procedures. (4) Excellent writing skills as demonstrated by Legal Briefs, Memoranda, and letters. (5). Ability to deal effectively with Senior Officials as clients. (6). Excellent oral communications skills. The minimum requirements must be met before an applicant is eligible for further consideration. EXPERIENCE: Applicant must have three or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.




  • Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).




  • Bar Membership: An applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
